✓ Why You Can't Be Sued — Design

Legit

TryEchopulse is NOT a background check company. It is a user-owned, consent-first portable credential wallet like Checkr Profiles (1M+ users) and Willo Verified Profiles (£3M raise). User records voice challenge, user consents, user shares /p/ link. Employer views what user shared. This is NOT a Consumer Report under FCRA.

We report scores, not accusations: "deepfakeRisk: 0.8% low", "proxyRisk: LOW", "botScore: 3.2%". We NEVER say "John is fake / fraud". We say "unverified" vs "Blue Tick ✓ Verified via third-party". This prevents defamation.

1. BIPA (Illinois Biometric Law) — $1k-$5k per violation — COMPLIANT

What law requires: Written consent + retention policy + destruction schedule + no sale.

What we do:
• Consent modal with 2 checkboxes before any recording (see consentModal)
• Retention: Voice biometric templates stored max 365 days, then auto-deleted. See consent text: "Data expires in 365 days"
• Destruction: "Delete Forever (BIPA/GDPR)" button calls deleteAll() — removes localStorage, audioBlob, proofData, VC JWT. Server side: DELETE /api/delete?user=xxx purges within 24h
• No sale: We never sell biometric data to third parties. Policy: "No sale to third parties"
• Public policy page: This /legal page IS your retention policy per BIPA 740 ILCS 14/15(a)

Why low risk vs Persona: Persona stores face scans. We store voice challenge + breath/tremor (lower sensitivity) + optional. User can use without face. Persona got sued for face. We avoid face.

2. FCRA — Not a Consumer Reporting Agency — COMPLIANT

FCRA risk: If you sell reports ABOUT someone to employer, you are CRA and need FCRA compliance (disclosures, adverse action, etc). Checkr IS a CRA.

What we do:
• TryEchopulse is NOT a CRA. User self-attests. User controls data. User shares link. This is "user-provided information" exception under FCRA 603(e).
• ToS: "TryEchopulse is a portable credential wallet. It is not a consumer reporting agency under FCRA (15 U.S.C. § 1681 et seq). Information is provided by user, not by us. Employers must conduct independent verification for hiring decisions."
• We do NOT pull secret data about person without consent. All edu/work verification uses zkTLS: user logs in to their own university/Workday, proves it, we see proof, not password.

3. Defamation + Edu/Work Verification — Score Not Accusation

• Never label "fraud". Use: "unverified" / "verified via third-party" / "Blue Tick ✓" / "REVIEW — possible proxy, manual check recommended"
• Edu verification: Uses National Student Clearinghouse + zkTLS, not scraping. University cannot sue — student consents via Clearinghouse, which is authorized source. Same as Willo.
• Work verification: Uses Workday + LinkedIn + payroll via user consent, not scraping employer private DB.
• Company cannot sue you for user saying "I worked at Acme" — that's user's speech, Section 230 protects platform for user-generated content.

4. GDPR + CCPA + Document Forensics + VPN/TOR — COMPLIANT

• GDPR Art.9 biometric: Consent checkbox = explicit consent. Deletion = right to erasure. We support both.
• VPN/TOR flag: We report as "network intelligence" (like Checkr IDV + Socure). We do NOT auto-reject VPN. We say "VPN:false, info only" + "recommendation: PASS". Prevents discrimination claim.
• Document forensics: We do NOT store ID images unless Pro user opts in for blue tick doc check. If we do, store encrypted, delete after verification, per Veriff pattern (1 in 25 fraud rate protected).
• Portable ID: Works for hiring + freelance + marketplace + dating — like Checkr Profiles. Broader market, same legal.

5. ToS Disclaimers to Add (Copy-Paste to Stripe/Privacy)

TERMS — TryEchopulse
- TryEchopulse is a user-controlled portable credential wallet, not a consumer reporting agency under FCRA (15 U.S.C. §1681). Information is self-attested by user and optionally verified via third-party zkTLS with user consent.
- Blue Tick ✓ means data verified via third-party at time of check (National Student Clearinghouse, Workday, GitHub, etc). Not a guarantee of future behavior. Continuous Trust re-verifies every 90 days per HireRight 2026 trend.
- Interview Guard scores (deepfakeRisk, proxyRisk, botScore, vpn, tor) are risk signals, not determinations of fraud. Recommendation "REVIEW" means manual check recommended.
- Voice biometric templates: Retained max 365 days, deleted on user request within 24h via Delete Forever button or DELETE /api/delete. No sale to third parties. Retention policy per BIPA 740 ILCS 14/15(a) published at /legal.
- No scraping: We do not scrape LinkedIn, university, or employer private databases. Edu/work verification via user-authorized zkTLS or official third-party APIs.
- Section 230: User-generated content (skill titles, work company names) is user's speech.

- Storage: Voice template SHA-256 hash + liveness signals, encrypted at rest.
